Love Has No Borders: Sponsoring Your Same-Sex Partner for US Immigration

As of October 26, 2023, the good news is YES! You can absolutely sponsor your same-sex partner for immigration to the US. Here's your guide to navigating the process:

1. Check Your Eligibility:

First things first, make sure you meet the basic requirements. You, as the sponsoring US citizen or permanent resident, must be legally married to your partner. Remember, love is love, and your marital status is recognized for immigration purposes.

2. File the Petition:

This is where it gets official! You'll need to file Form I-130, Petition for Alien Relative, on behalf of your partner. It establishes your qualifying relationship and starts the ball rolling.

3. Gather Your Proof:

Love stories need evidence too! Collect documents proving your US citizenship or green card, your marriage certificate, and other required documentation. Think of it as building a strong case for your happily ever after.

4. Pay the Fees:

Like any administrative process, there are fees involved. Consider them an investment in your shared future.

5. Wait for Approval:

(with Fingers Crossed)

USCIS will review your petition. Once approved, it's sent to the National Visa Center (NVC) to move things forward.

6. Choose Your Path:

If your partner is already in the US, you can pursue "adjustment of status" to get their green card here. Otherwise, it's "consular processing" through the US embassy or consulate in their home country.

7. Interview Time:

(if applicable)

For consular processing, your partner will have a visa interview. Remember, preparation is key!

8. Welcome Home!

(Or Green Card Time!)

Visa approved? Your partner can finally join you in the US! If adjusting status, they'll receive their green card and officially become a US resident.
