Visiting While Waiting for a K-1 Visa

Thinking of having your fiancé(e) visit the US while you wait for their K-1 visa? Here's a heads-up:

  • Visitor Visa Needed: Unless your fiancé(e) is from a visa-free country, they'll need a visitor visa (B-2) to enter.

  • Be Honest About Intent: They must clearly state their intention to marry you and pursue a K-1 visa. Don't mislead immigration officials!

  • Visitor Visa Limits: These visas usually allow a maximum 6-month stay. Make sure your fiancé(e) follows the rules and leaves on time.

  • Dual Intent Allowed (Usually): Having a visitor visa (with a temporary purpose) while applying for a K-1 (with immigration intent) is generally okay (dual intent).

  • Potential Scrutiny: Be aware that applying for both visas simultaneously might raise questions for immigration officers. They might suspect your fiancé(e) plans to overstay the visitor visa.

  • Talk to an Attorney: Considering a visit? Consult an immigration attorney. They can explain the risks and ensure your fiancé(e) meets all visa requirements.

Remember: While a pre-K-1 visit is possible, be cautious and understand the implications involved.
