Dependents on I-129 Petition

Thinking of bringing your family with you on a work visa? Great news! You might be able to include them on your Form I-129 petition, depending on the visa category.

Here's a quick guide for some common visas:

  • H-1B Specialty Occupation: Spouses and unmarried children under 21 can be included.

  • L-1 Intracompany Transferee: Same as H-1B - spouses and children under 21 qualify as dependents.

  • O-1 Extraordinary Ability/Achievement: Similar to H-1B/L-1, spouses and children under 21 might be eligible.

  • TN NAFTA Professional: Spouses and children under 21 may be included under NAFTA provisions.

Remember:

  • Always check specific requirements for each visa category.

  • Provide accurate information about your dependents on the form.

  • Consult an immigration attorney for personalized guidance (optional but recommended).
