Update for FY 2025 H-1B Cap Applicants

Great news for those waiting on the H-1B cap selection for fiscal year 2025!

The U.S. Citizenship and Immigration Services (USCIS) has completed the second round of random selection from registrations submitted earlier this year. This means they've chosen enough applications to reach the H-1B cap for this year.

What this means for you:

  • Check your inbox! USCIS has notified everyone with a selected registration. If you haven't heard from them yet, your application wasn't chosen this time around.

  • Selected? Time to act! If you were lucky enough to be selected, you can now file an H-1B cap-subject petition for the beneficiary named in your selection notice. Be sure to follow the instructions carefully and meet the filing deadline.

  • Masters Cap Update: There was no need for a second selection for the advanced degree exemption (master's cap) as they received enough applications from the first round.

  • Double-check the details: Make sure to file your petition at the correct location (online or by mail) and within the timeframe specified in your selection notice. You'll also need to include a copy of the selection notice with your petition.

  • Selection doesn't guarantee approval: Being selected allows you to file a petition, but USCIS will still review it based on existing regulations to determine final approval.

Important Fee Reminders:

  • The H-1B cap filing fees changed on April 1, 2024. Make sure you're paying the current fee to avoid delays.

  • USCIS is only accepting the new April 1, 2024 edition of Form I-129 (Petition for a Nonimmigrant Worker).

  • The premium processing fee for Form I-907 (Request for Premium Processing Service) also increased in February 2024. Be sure to pay the correct amount to avoid rejection.
