Traveling on a K-1 Fiancé Visa

Thinking of traveling outside the US with your K-1 fiancé(e)? Here’s what you need to know:

  • Hold Off on Early Trips: Avoid leaving the US right after arrival, especially before marriage and applying for a green card (adjustment of status). This might raise questions about your intent to marry.

  • Advance Parole for Pending Adjustment: If travel is necessary, get “Advance Parole” (Form I-131) from USCIS. This allows re-entry without abandoning your green card application.

  • Conditional Approval Notice (Form I-797): This temporary approval might help with re-entry while your application is pending, but it doesn’t guarantee it.

  • Re-entry Challenges: Be prepared for delays or questioning by Customs and Border Protection (CBP) upon re-entry.

  • Marry & Apply for Green Card First: Apply for adjustment of status (Form I-485) as soon as possible after marriage. Traveling can complicate this process.
