L-1 Visa Application Process
Thinking of transferring to a US branch of your multinational company? The L-1 visa might be your answer. Here's a quick breakdown of the process:
Step 1: Check Eligibility
Are you an executive, manager, or specialized knowledge worker?
Is your company transferring you to a US affiliate, branch, subsidiary, or parent company?
There are 2 types of L-1 visas: L-1A for managers/executives and L-1B for specialized knowledge.
Step 2: Employer Files Petition (Form I-129)
Your US employer files a petition with USCIS to request your L-1 visa.
This petition proves your qualifications and the connection between the companies.
Step 3: Petition Approval (Form I-797)
USCIS approves the petition and your employer receives a notice.
If you're abroad, your employer will send you a copy.
Step 4: Apply for Visa (DS-160 Online)
You complete an online visa application (DS-160) at a US embassy/consulate in your home country.
Pay the visa application fee and schedule an interview.
Step 5: Visa Interview at US Embassy/Consulate
Attend the interview where a consular officer will assess your qualifications and ties to your home country.
The officer will decide to approve or deny your visa application.
Step 6: Travel to the US (if Approved)
If approved, you'll receive the L-1 visa in your passport.
You can travel to the US and present the visa at the port of entry.
Step 7: Status Change to L-1 (if Applicable)
Upon entry, your status will be changed to L-1.
If already in the US with a different status, you might be able to change to L-1 without leaving.
Remember: Both you and your employer should follow these steps carefully for a smooth transfer to the US.
